Terms of service
Terms of Service
Effective Date: 24 July 2026
These Terms of Service explain the rules that apply when you browse, shop or place an order with UnderToneSA.
By using our online store, you agree to these Terms of Service and the policies referenced within them. Please read these terms carefully before using our website or placing an order. If you do not agree with them, please do not use the store.
Mandatory consumer rights under applicable South African law always take priority.
1. About These Terms
These Terms of Service apply to your access to and use of the UnderToneSA online store, including browsing, purchasing products and interacting with features made available through the website.
References to “UnderToneSA”, “we”, “us” or “our” mean the operator of this store. References to “you” or “your” mean the person using the website or placing an order.
2. Eligibility and Acceptance
By using the store, you confirm that you are legally capable of entering into this agreement or that you are using the store with the permission and supervision of a parent or legal guardian.
Placing an order confirms your acceptance of these terms and the policies referenced in them.
3. Permitted Use of the Store
You may use the store for lawful personal shopping and information purposes.
You agree not to misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape content without permission, or use the store in a way that violates applicable law or another person’s rights.
4. Product Information
We aim to present product descriptions, images, sizes, directions and benefits as accurately as reasonably possible. Screen settings, packaging updates and normal production variations may affect how colours or product presentation appear.
Product results and experiences may differ from person to person. Product information is provided for general guidance and is not a substitute for personalised medical advice.
Please follow the directions and warnings provided with each product.
5. Availability and Purchase Limits
Products are offered subject to availability.
We may reasonably limit quantities, withdraw a product or decline an order where stock is unavailable, an order appears fraudulent, a price is clearly incorrect, or another legitimate reason prevents fulfilment.
Any action we take remains subject to applicable law.
6. Pricing and Payment
Unless clearly stated otherwise, prices are displayed in South African rand.
Applicable product prices, discounts, delivery charges and the total cost of your order will be displayed during checkout before payment is completed.
Payment must be authorised using a payment method offered at checkout.
Payment processing may be provided by third-party payment providers and may be subject to their own terms, conditions and security procedures.
7. Orders and Confirmation
You are responsible for checking your order, delivery address and contact details before completing checkout.
An automated order confirmation acknowledges that we have received your order. Fulfilment remains subject to payment confirmation, stock availability and reasonable verification checks.
If we cannot fulfil an order after payment has been made, we will notify you using the contact details provided and arrange the appropriate refund.
8. Corrections and Cancellations
Please contact us promptly if you need to correct or cancel an order.
We will make every reasonable effort to assist, but changes or cancellations cannot be guaranteed once processing or dispatch has begun.
9. Shipping and Delivery
We deliver across South Africa and aim for delivery within 8–14 business days.
Delivery dates are estimates and may be affected by your location, order volumes, courier conditions and circumstances outside our reasonable control.
Full delivery details are available in our Shipping Policy.
10. Returns and Refunds
Our 30-day satisfaction promise and the process for requesting a return or refund are explained in our Returns & Refunds Policy. That policy forms part of these Terms of Service.
Nothing in these terms or our store policies limits rights or remedies that cannot lawfully be excluded under applicable South African consumer law.
11. Policy Priority
Product-specific terms and our published Shipping, Returns and Privacy policies apply alongside these Terms of Service.
If there is an inconsistency, mandatory law takes priority, followed by the more specific applicable policy for that subject.
12. Personal Information
We process personal information to operate the store, fulfil orders, provide support, prevent fraud and perform other activities described in our Privacy Policy.
By using the store, you acknowledge that personal information will be handled as described in that policy and in accordance with applicable privacy law.
13. Intellectual Property
The UnderToneSA name, branding, website design, written content, product photography, graphics and other original store material are owned by or licensed to UnderToneSA and are protected by applicable intellectual property laws.
You may view and use the website for personal shopping purposes.
You may not reproduce, republish, sell, modify or commercially exploit our content without prior written permission, except where expressly permitted by law.
14. Reviews and Submitted Content
If you submit a review, image, comment or other content, you confirm that it is honest, lawful and relevant and does not violate another person’s privacy, intellectual property or other rights.
You grant UnderToneSA a non-exclusive, worldwide and royalty-free licence to display, reproduce and adapt submitted content for the purposes of operating and promoting the store, subject to applicable privacy and consumer law.
We may moderate or remove content that is unlawful, misleading, abusive, irrelevant or otherwise inappropriate.
15. Third-Party Services and Links
Our store may use or link to services operated by third parties, including Shopify, payment providers, delivery partners and social media platforms.
These services may be governed by separate terms and privacy policies.
We are not responsible for third-party websites or services that we do not own or control, except to the extent that responsibility cannot lawfully be excluded.
16. Website Availability and Errors
We work to keep the website accurate, secure and available but cannot guarantee that access will always be uninterrupted or error-free.
Maintenance, technical issues and circumstances outside our reasonable control may affect website availability.
We may correct genuine typographical, pricing or product-information errors.
If a material correction affects an order you have already placed, we will notify you and provide the options required by applicable law.
17. Responsible Product Use
Products should only be used as directed. Please review the relevant product information before use.
Introduce new skincare products thoughtfully, patch test where appropriate and stop using a product if it causes persistent discomfort.
Seek appropriate professional advice if you have a medical condition, known allergy or concern requiring individual guidance.
18. Liability and Mandatory Rights
To the fullest extent permitted by law, neither party will be responsible for indirect or consequential loss that was not reasonably foreseeable and did not arise from that party’s breach of a legal duty.
Nothing in these terms excludes or limits liability, warranties, remedies or consumer rights that cannot lawfully be excluded or limited, including applicable rights under the South African Consumer Protection Act.
19. Suspension or Termination
We may restrict or end access to the store where a user materially breaches these terms, acts unlawfully, threatens store security or misuses our services.
This does not affect rights and obligations relating to valid orders already placed, except where applicable law allows otherwise.
20. Changes to These Terms
We may update these terms when our services, policies or legal obligations change.
The current version will be published on our website with an updated effective date. Changes apply from publication unless applicable law requires another approach.
Changes will not remove rights already acquired in relation to an order where doing so would be unlawful or unfair.
21. Severability and No Waiver
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce a right, this does not mean that we permanently waive that right.
22. Governing Law and Disputes
These Terms of Service are governed by the laws of the Republic of South Africa.
We encourage you to contact us first if you have a concern so that we can attempt to resolve it professionally and efficiently.
Nothing in this clause prevents you from using any court, tribunal, consumer commission or dispute-resolution process available to you under applicable law.
23. Contact Information
Questions about these terms, your order or the UnderToneSA store can be submitted through our Contact page.
If your enquiry relates to an existing purchase, please include your order number so that we can assist you efficiently.
Statutory Rights
These Terms of Service are intended to create a clear and fair agreement between UnderToneSA and its customers.
Nothing in these terms requires you to waive any protection, right or remedy that cannot be waived under applicable South African law.
These terms should be reviewed periodically and whenever UnderToneSA changes its products, fulfilment practices, payment methods or customer policies.
